Terms and Conditions of Sale
Ottis African Market UK, a trading name of Ottis African Market UK Ltd
These Terms and Conditions govern all purchases made through www.ottisafricanmarket.co.uk, and through our TikTok Shop, Amazon, and eBay storefronts operated under the name Ottis African Market UK (together, "our platforms"). By placing an order with us, you agree to be bound by these Terms and Conditions. Please read them carefully before completing your purchase.
1. Who We Are
Ottis African Market UK is a trading name of Ottis African Market UK Ltd, a company registered in England and Wales. Our registered and trading address is 20 Cross Flatts Drive, Leeds, LS11 7HY. You can contact us by email at info@ottisafricanmarket.co.uk or by telephone on 07766551846. In these Terms and Conditions, "we", "us" and "our" refer to Ottis African Market UK Ltd trading as Ottis African Market UK, and "you" and "your" refer to the customer placing an order.
We are a registered food business with Leeds City Council. Our current food hygiene rating status can be checked at ratings.food.gov.uk.
2. Our Products
We sell a range of African food products, including dried and packaged goods, spices, and other grocery items, sourced both from United Kingdom suppliers and, where stated, imported from Nigeria in accordance with applicable United Kingdom import and food safety law.
We take reasonable care to ensure that product descriptions, images, and pricing on our platforms are accurate at the time they are published. However, slight variations in packaging, weight, or appearance may occur between the image shown and the product delivered, particularly for imported goods. Such minor variations do not entitle you to a refund unless the product delivered is materially different from its description, faulty, or not fit for purpose.
Where a product is temporarily unavailable after you have placed an order, we will contact you as soon as reasonably possible to offer a substitute of equivalent value, a delay in dispatch, or a full refund for that item.
3. Allergen and Ingredient Information
We take food safety and allergen labelling seriously. In accordance with the Food Information for Consumers Regulations and United Kingdom food law, including the requirements applicable to distance selling, we provide allergen information in two stages:
● Before you complete your purchase, allergen information is available on the product listing on our platforms, or available on request by contacting us before you order.
● At the point of delivery, allergen and ingredient information is provided on the product packaging or in an accompanying document, in written form.
The fourteen allergens regulated under United Kingdom law are: celery, cereals containing gluten, crustaceans, eggs, fish, lupin, milk, molluscs, mustard, peanuts, sesame, soybeans, sulphur dioxide and sulphites (above ten parts per million), and tree nuts. If you have a food allergy or intolerance, please contact us before ordering so that we can confirm the current ingredient composition of any product, as recipes and sourcing may change between orders.
We cannot guarantee that any product is entirely free from traces of a particular allergen unless this is expressly stated on the packaging, because our products are prepared, packaged, and stored in environments where a range of ingredients are handled.
4. Placing an Order
When you place an order through any of our platforms, you are making an offer to purchase the products in your basket. A contract between you and us is formed only when we confirm your order, either by email confirmation or by an equivalent confirmation through the relevant marketplace platform (TikTok Shop, Amazon, or eBay). We reserve the right to decline or cancel an order before this point, for example where a product is unavailable, where pricing has been displayed in error, or where we reasonably suspect fraudulent activity.
All orders are subject to acceptance and availability. Prices are shown in pounds sterling and are inclusive of any applicable value added tax, unless stated otherwise. Delivery charges, where applicable, are shown separately at checkout and are confirmed before you complete your purchase.
5. Payment
Payment is taken at the time of order through the payment methods made available on the relevant platform. We accept payments processed through our approved payment providers. We do not store your full card details. If a payment fails or is declined, your order will not be processed and we will notify you where possible.
6. Delivery
We aim to dispatch and deliver orders within a reasonable time, and in any event within thirty days of the date of your order, unless a different delivery timeframe is stated on the relevant product listing or agreed with you separately. Delivery timeframes are estimates and, while we take reasonable steps to meet them, they are not guaranteed, particularly where a product is imported and subject to customs clearance.
Risk in the products passes to you at the point of delivery to the address you provide. You are responsible for ensuring that the delivery address and contact details you provide are accurate and complete.
If your order does not arrive within the estimated delivery window, please contact us so that we can investigate with our courier or freight partners.
7. Your Right to Cancel
If you are a consumer, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within fourteen days of receiving your goods, without giving a reason, subject to the exceptions set out below.
To cancel, you must inform us clearly of your decision to cancel, for example by email to info@ottisafricanmarket.co.uk, before the fourteen day period expires. If you cancel, you must return the goods to us without undue delay and in any event within fourteen days of telling us you wish to cancel. You will be responsible for the direct cost of returning the goods, unless we have agreed otherwise or the goods are faulty or not as described.
We will refund you the price you paid for the cancelled goods, including standard delivery charges, within fourteen days of receiving the returned goods or evidence that you have sent them back, whichever is earlier. We may make a proportionate deduction from your refund if the value of the goods has been reduced as a result of unnecessary handling by you beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
7.1 Exceptions to the Right to Cancel
Because we sell perishable and food items, the right to cancel does not apply to the following, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013:
● Goods that are perishable or liable to deteriorate or expire rapidly.
● Sealed goods that are not suitable for return for health protection or hygiene reasons, where they have been unsealed by you after delivery.
● Goods made to your specification or clearly personalised.
Where an item is excluded from the right to cancel, this will be made clear on the relevant product listing.
8. Faulty, Damaged, or Incorrect Goods
Under the Consumer Rights Act 2015, you have a legal right to receive goods that are of satisfactory quality, fit for purpose, and as described. If a product you receive is faulty, damaged in transit, incorrect, or not as described, please contact us as soon as reasonably possible, and in any event within thirty days of delivery, so that we can offer a repair, replacement, price reduction, or refund as appropriate under the Act.
Please retain packaging and, where possible, provide photographs of the issue to help us resolve your query quickly. This section does not affect your other statutory rights as a consumer, which remain unaffected by anything in these Terms and Conditions.
9. Business Customers
If you are purchasing as a business rather than as a consumer, the statutory cancellation rights described in section 7 do not apply, and our liability to you is limited to the price paid for the relevant order, save in respect of death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded or limited.
10. Our Liability
We provide our products with reasonable care and skill and in accordance with our obligations under United Kingdom consumer law. Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.
Subject to the above, we are not liable for any indirect or consequential loss arising from your use of our products, nor for losses that were not reasonably foreseeable to both parties at the time the contract was formed.
11. Complaints and Disputes
If you are unhappy with your order or with any aspect of our service, please refer to our separate Complaints and Refund Policy, which sets out how to raise a complaint and how we will handle it. We aim to resolve all complaints fairly and promptly.
If a dispute cannot be resolved directly between us, you may be entitled to refer the matter to a certified Alternative Dispute Resolution provider. We will confirm at the time whether we agree to participate in Alternative Dispute Resolution. This does not affect your right to bring a claim through the courts.
12. Governing Law
These Terms and Conditions, and any dispute or claim arising out of or in connection with them, are governed by the law of England and Wales. The courts of England and Wales will have non-exclusive jurisdiction over any such dispute, meaning you may also be able to bring proceedings in your own country of residence if you are a consumer living elsewhere in the United Kingdom or the European Union.
13. Changes to These Terms
We may update these Terms and Conditions from time to time, for example to reflect changes in the law or in how we operate our business. The version of the Terms and Conditions that applies to your order is the version published on our platforms at the time you place your order. If we make material changes, we will take reasonable steps to bring this to your attention.
14. Contact Us
If you have any questions about these Terms and Conditions, please contact us at info@ottisafricanmarket.co.uk, by telephone on 07766551846, or by post at 20 Cross Flatts Drive, Leeds, LS11 7HY.
